TERMS & CONDITIONS
Welcome to Citadel Fence and Deck. These terms and conditions (the "Terms") outline the rules and regulations for the use of our website and services. By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, please do not use our services.
1. Definitions
"We," "Us," and "Our": Refers to Citadel Fence and Deck.
"Client," "You," and "Your": Refers to the individual or entity using our services.
2. Services
We provide the following services:
-Fence repair
-Fence replacement
-Gate construction and installation
-Deck building
-Deck repair
-Post hole digging services
-Longevity services (Sanding, Staining, Sealing, Minor Repairs)
The specific details, timelines, and deliverables of each service will be outlined in a separate agreement between us and the client.
3. Payment Terms
A 10% deposit is required to initiate your project. This is non-refundable. This deposit is due immediately and initiates your project. We require 2-3 weeks to schedule your project, get permission to dig and plan out materials and labor. The specific details, timelines, and deliverables of each service will be outlined in a separate agreement between us and the client.
50% deposit is due to set a firm start date. Our president will come to the job site and finalize all details with you.
The remaining 40% is due within 24 hours of project completion. You will receive confirmation for every transaction for your records.

Cash
E-transfer (michael@citadelfenceanddeck.ca)
Credit card (A 3% surcharge will be added for credit card transactions.)
4. Cancellation Policy
You may cancel your project up to the scheduled site visit from our president.
Your 10% deposit is non-refundable
5. Property Damage and Maintenance
We make every effort to keep your property clean and undamaged. However, we cannot be held liable for any damage caused by:
-Machinery used for construction
-Post hole digging
-Waste bin placement and removal
If you have any concerns, please notify Citadel Fence and Deck before work begins.
6. Limited Craftsmanship Warranty
-We offer a one-year limited warranty on our workmanship, effective from the date of completion.
-If you have concerns about the integrity, craftsmanship, or quality of our work, contact Michael at Citadel Fence and Deck, and we will make it right.
-Wood Disclaimer: Wood is a natural product and may twist, crack, or warp over time. We are not liable for the natural aging of wood materials used in our projects.
7. Intellectual Property
All materials, including but not limited to project plans, designs, and construction techniques, remain the intellectual property of Citadel Fence and Deck unless otherwise stated.
8. Confidentiality
Both parties agree to keep confidential any sensitive information disclosed during the business relationship. This includes business strategies, customer data, and other proprietary information not publicly known.
9. Limitation of Liability
Citadel Fence and Deck will not be held liable for any indirect, consequential, or punitive damages arising from the use of our services. Our total liability will not exceed the total amount paid by the client for the specific service in dispute.
10. Indemnification
You agree to indemnify and hold Citadel Fence and Deck harmless against any claims, losses, or expenses resulting from your use of our services or breach of these Terms.
11. Third-Party Services
Our website or services may contain links to third-party websites or services. We are not responsible for the content, practices, or reliability of these third-party services.
12. Modifications
We reserve the right to update these Terms periodically. Any significant changes will be communicated to clients. Continued use of our services after the changes signifies acceptance of the new Terms.
13. Termination
Either party may terminate an agreement with written notice if the other party breaches a material obligation and fails to rectify it within a reasonable time. Upon termination, all outstanding fees are payable immediately.
14. Governing Law
These Terms are governed by the laws of Ontario, Canada. Any disputes will be resolved in the courts of Ontario, Canada.
